Terms of Use
Effective date: April 13, 2025
Welcome to HipTrip. By accessing or using our website and services (collectively, the “Service”), you agree to be bound by these Terms of Use (“Terms”). Please read them carefully. If you do not agree, do not use the Service.
HipTrip is operated by RB Code Labs LLC (“we,” “us,” or “our”).
1. Using HipTrip
You must be at least 18 years old to use the Service. By using HipTrip you represent that you meet this requirement. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You agree not to use the Service to:
- Violate any applicable law or regulation.
- Scrape, crawl, or otherwise systematically extract content or data without our written permission.
- Attempt to gain unauthorized access to any part of the Service or its infrastructure.
- Transmit spam, malware, or any content that is harmful, fraudulent, or deceptive.
- Reverse-engineer or otherwise attempt to derive source code or underlying models.
2. Accounts and Authentication
HipTrip uses passwordless email sign-in (“magic links”). You must provide a valid email address to create an account. You are responsible for keeping your email account secure, as access to it grants access to your HipTrip account.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with reasonable notice where practicable.
3. AI-Generated Itineraries
HipTrip uses artificial intelligence to generate personalized trip itineraries. You acknowledge and agree that:
- AI-generated content is provided for informational and planning purposes only. It may contain errors, inaccuracies, or outdated information.
- Trail conditions, road closures, permit requirements, business hours, and other real-world details change frequently. Always verify critical information with official sources before your trip.
- HipTrip does not guarantee the accuracy, completeness, or fitness for purpose of any generated itinerary.
- You are solely responsible for your own safety and decision-making during any outdoor activity described in an itinerary.
4. Outdoor Activity Risk
Hiking, biking, and other outdoor activities involve inherent risks including injury, illness, extreme weather, and death. By using HipTrip to plan outdoor activities, you acknowledge these risks and agree that you are voluntarily participating with awareness of those risks.
HipTrip is a planning tool, not a safety system. Always:
- Check current trail and weather conditions before departing.
- Carry appropriate gear, navigation tools, and emergency supplies.
- Let someone know your itinerary and expected return time.
- Comply with all regulations for the lands and waterways you visit.
5. Payments and Credits
Certain features — including unlocking full itinerary details and maps — require purchasing credits. All payments are processed securely by Stripe. By making a purchase you also agree to Stripe's terms of service.
Credits are non-refundable and non-transferable except as required by applicable law. Credits have no cash value. If you close your account, unused credits are forfeited. If we terminate your account without cause, we will refund the value of any unused credits at the price paid. We reserve the right to change pricing at any time; changes will not affect credits already purchased.
If you believe a payment was processed in error, contact us at hello@hiptrip.com within 30 days of the transaction.
6. Your Content
You retain ownership of any content you create within HipTrip, such as notes, edits, and trip details (“User Content”). By submitting User Content, you grant HipTrip a non-exclusive, worldwide, royalty-free, sublicensable license to store, display, reproduce, and process that content solely to provide and improve the Service (including delivery via CDN and infrastructure providers).
You are responsible for ensuring that any User Content you submit does not infringe third-party intellectual property rights or violate any law.
Feedback
If you submit ideas, suggestions, or feedback about the Service (“Feedback”), you agree that HipTrip may use that Feedback freely and without restriction or compensation. Feedback is not treated as confidential.
7. HipTrip Content and Intellectual Property
All curated trip guides, editorial content, UI design, trademarks, and other materials provided by HipTrip are owned by or licensed to us. You may use them only as permitted by the Service for your personal, non-commercial trip planning. You may not reproduce, redistribute, or create derivative works from our content without prior written permission.
8. Third-Party Services
The Service integrates with third-party providers including Stripe (payments), Google Places (location data), OpenAI (AI generation), and Resend (email delivery). Your use of the Service is also subject to the terms and privacy policies of those providers. HipTrip is not responsible for the practices or content of third-party services.
9. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HIPTRIP AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) $5.00 OR (B) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
11. Changes to These Terms
We may update these Terms from time to time. We'll notify you of material changes by email or by posting a notice in the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Michigan.
